ORC Rules On Shakes Appeal

The Ontario Racing Commission has released its ruling in regard to an appeal by horseman Brad Shakes.

Shakes' appeal was in regard to a fine, suspension, and terms which were imposed on his ORC license due to a December 6, 2011 race in which a horse he trained (High Def Z Tam) returned positive tests for the Class II substances Caffeine, Theophylline, and Theobromine.

Upon hearing the testimony of Steve Rushton, Pamela Bray, Jacklyn Goldman, Dr. Elizabeth Shiland, Michel Georgakakis, and Shakes, considering the exhibits filed, and reviewing the written submissions of counsel, the ORC Panel which presided over the appeal dismissed it as to liability and penalty.
