MacDonald Wins Stakes Appeal

The Ontario Racing Commission (ORC) issued its decision on the appeal of James MacDonald, Dawn Anderson and Tony O'Sullivan on Friday, Aug. 22.

MacDonald, Anderson, and O’Sullivan appealed against Rulings Number SB 46054 and SB 46052 dated July 14, 2014, issued to James MacDonald and the horse Manny In Sports, respectively, for violation of Rule 18.08.02 (c) of the Rules of Standardbred Racing during race two at Mohawk Racetrack on July 7, 2014.

The Panel allowed the appeal. The original placing of 1st is restored and James MacDonald's fine and three day suspension are revoked.

My $100 win and place goes where....charity?
This happened to me last year and all my questions and concerns went on deaf ears then and today.....same.
The owners get paid, the driver gets paid,the trainer gets paid and I make a contribution to the cause.

Where on earth do we draw the line?The ORC rule book is very clear about
stretch drive pylon violations.Each driver is responsible for his own
actions with the horse he is driving.You cannot use Mr.McNair´s horse as
an excuse for the decision made to go inside a pylon.Green horse or not
makes no difference,and as for what Colonys Best was wearing for equipment
is of no importance either.Should be interesting from here on in,especially
these so called ´GREEN´horses when they are racing on the tighter turns of
half mile tracks.

Absolutely unbelievable. It boggles the mind some of the decisions reached by those in charge of this industry. I have even seen cases in which horses win despite finishing the race well inside the pylons. A horse doesn't even have to finish a race on the racetrack to win! The removal of the hubrail has made bad mannered horses and bad driving decisions come out winners and has given judges more fodder for annoying the punters.

How about the "fans"/bettors who were silly enough to wager on Manny in Sports?

I'd have to agree on the previous statement. Green horses or not this horse went "INSIDE" 3 pylons and certainly gained an advantage. I love to see local guys do well BUT in this case it will be very very difficult to make any other decision than this in the future. The panel has certainly set a new bar. This was a mistake in my opinion. Let's wait till the next pylon violation by a so called " Green Horse ". If the outcome is not the same, be assured Lawyers will be involved. The ORC just opened a flood gate.

This is quite simply, a bad decision. Had there been a hub rail still in the mix, well we know those results. The hub rail was ( thankfully ) removed for safety purposes and replaced by the pylons. They were always deemed to be the same barrier for the guidelines set to insure everyone raced the same legal distance and the same rules, no exclusions. To hear the argument of a green horse blew me away. Are not all 2yr olds green horses ?? That is also the case for lightly raced 3yrolds and lets not forget the occasional orangatang. This opens a whole new precedent for any and all future appeals. Also correct me, but I thought more than one pylon was breeched. Anyway it doesn’t matter, 1, 2, 3 the results are the same and the flood gates are now open.

and what happens to my $20 WPS on Manny in Sports?
I would assume a shrug of the shoulders and oh well.
I was ticked when he was taken down.
I am even more mad now that his number has been put back up but it clearly isn't reflected in the payouts.
